SOBRE CAMBIOS IMPREVISTOS EN LAS RESERVAS POR PARTE DE LA RENTADORA:

Luego de Cerrar la Negociación de la Reserva y el Cliente tener en su poder el Voucher , el Cliente debe conocer que no es nuestra intención realizar ningún cambio en su reserva, excepcionalmente sucede que los acuerdos a veces se realizan con mucha anticipación y, por lo tanto, no podemos tener el control de los cambios imprevistos por situaciones coyunturales.

En caso de cambios menores en el Punto de Renta, en CUBACARTRAVEL haremos todo lo posible para notificarle, sin embargo, puede que no podamos hacerlo y esto no nos obliga a compensarle.

En caso de cambios importantes, como, cambiar la categoría del automóvil por categorías inferiores, haremos todo lo posible para notificarle antes de su llegada. En estos casos tienes la posibilidad de:

  1. Accept the alternative that we can offer you
  2. Change the reservation by paying extra or receiving a refund for the difference
  3. Cancel the reservation and receive a full refund

Para las reservas confirmadas cuando se interese su Cancelación o Modificación se procederá de acuerdo a los términos siguientes:

  1. Para un término de entre 60 a 30 días de antelación al inicio de la reserva se aplicará una penalidad correspondiente al 25% del valor de los días renta de la reserva.
  2. Para un término de entre 30 a 15 días de antelación al inicio de la reserva se aplicará una penalidad correspondiente al 50 % del valor de los días renta de la reserva.
  3. Para un término inferior a 15 días de antelación al inicio de la reserva y/o No Show se aplicará una penalidad correspondiente al 100% del valor de los días renta de la reserva.

Requests for cancellation or modification once the reservation has been paid must be made in writing by email.

Después de iniciado el servicio, decides no utilizar parte de los días de renta contratados, no es aceptada la solicitud de devolución del pago, excepto previa presentación del Contrato de Renta exponiendo Causas Justificadas con previo aviso a nuestros representantes.

If the client does not show up on the day of the start of the reservation (NO SHOW), this reservation will be considered automatically canceled and we will not accept any refund request.

After starting the service. If, after starting the service, you decide not to use part of the contracted rental days, we will not accept any refund request.

IMPORTANT NOTICE: The time zone that will be used in cancellations will be the one existing in the place where the services are provided: GMT -5.

CUBACARTRAVEL will not refund money to any credit card other than the one used by you in the reservation process. If the refund process is done by bank transfer, we will deduct any additional bank charges from the total amount to be refunded.

RESPONSABILIDAD.

Nothing in these terms in any way excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation or for any matter where it would be illegal or unlawful for us to exclude, limit or attempt to exclude or limit our liability. It also does not affect your statutory rights as a consumer.

Our liability, based in contract, tort (including negligence) or in connection with this contract for any event or series of events, shall be limited to 100% of the amount paid for the reservation.

In no case do you have the right to file a claim after 30 days have elapsed since the completion of your reservation.

Under no circumstances (including negligence) will we be liable for:

  • Special, indirect and consequential damages.
  • Any matter beyond our control, including without limitation: interruptions in basic services such as running water, electricity, gas, oil, etc., actions or omissions of the Cuban authorities or the loss or breach of security related to your information by our Internet Payment Service Provider.

CUBACARTRAVEL is not responsible for the actions or omissions of the owners, operators and providers of our services.

QUEJAS Y EMERGENCIAS.

All complaints must first be reported to the rental office representatives. CUBACARTRAVEL will not be responsible for any loss or damage caused by the acts, omissions or negligence of any service provider. You must contact CUBACARTRAVEL and we will try to help you solve any problem that may arise during your rental.

CUBACARTRAVEL will not accept any refund request if the client has not contacted our representatives in Cuba at the time of the incident.

We will not be responsible for any associated communication costs you may incur due to these causes.

 

ESTADO DE LOS CARROS.

CUBACARTRAVEL acts as an intermediary between the client and the car rental company and, therefore, we have no influence on the condition of the cars. Unfortunately, cars in Cuba do not always meet the quality standards found in other countries.

If the client signs the contract with the rental company and accepts the car at the time of collection, they will automatically accept that the car is fit to drive and, therefore, we will not accept refund requests related to the condition of the vehicle itself. CUBACARTRAVEL will try its best to help the client to change cars as long as they contact us before signing the contract.

In case of technical problems or accidents during the rental period, CUBACARTRAVEL is not responsible for offering roadside assistance or car repair. The customer will receive a service number from the car rental company and agrees to use that number and the services offered to repair or replace the car.

  • Abandonment of the vehicle or returned by another person who is not the owner of the contract
  • Refueling the vehicle with fuel other than that authorized or established by the owner entity or contaminated fuel
  • Affectations caused by accidents, breakage or loss of accessories
  • Loss or change of any part or aggregate of the vehicle or fit the shock absorbers
  • Placement of stickers or accessories on the motorcycle without the authorization of the rental company
  • Driving the vehicle aggressively or irresponsibly, with mistreatment of it
  • Unauthorized driver
  • Deterioration of the lining or cover of the seats
  • Delivery of the vehicle after the agreed date
  • Deliver dirty vehicle
  • Excess passengers
  • Loss or change of vehicle registration
  • Loss of carpet covers and boot carpet
  • Loss or damage of the ignition key
  • Loss of license plates or change without filing a complaint
  • Losses or deterioration of the contract or attached documents
  • Deprivation of the use of the vehicle
  • Towing another vehicle
  • If the key is left inside the vehicle for any reason
  • Transport animals
  • Use of the vehicle in circuits, races, competitions or similar contests
  • Using the vehicle in illegal activities
  • Maintenance violation
